You agree not to use our website to:

  • Violate any law or regulation
  • Interfere with website security or functionality

We may restrict, suspend, or terminate access to our website or services if we believe these Terms have been violated.

3. Restaurant Information, Menus, Pricing, and Availability

We work to keep our website accurate and current, but menu items, prices, ingredients, hours, specials, promotions, location availability, and services may change at any time without notice.

Menus, prices, specials, and offerings may vary by location. Some items may be seasonal, limited-time, unavailable, sold out, or discontinued.

If there is an error on our website, online ordering platform, menu, advertisement, promotion, or third-party listing, we reserve the right to correct the error and, where appropriate, cancel or adjust an order before fulfillment.

4. Online Ordering

Online ordering may be provided directly by Florida Cracker or through third-party ordering platforms, point-of-sale providers, delivery providers, or payment processors.

When you place an online order, you are responsible for providing accurate order details, contact information, payment information, pickup or delivery information, and selected location.

Estimated pickup or delivery times are estimates only and are not guaranteed. Delays may occur due to order volume, staffing, weather, technical issues, traffic, third-party delivery delays, or other circumstances.

We reserve the right to refuse, cancel, or modify orders due to item availability, pricing errors, suspected fraud, payment issues, operational limitations, or other reasonable business reasons.

5. Payments

Payment may be processed by third-party payment processors, online ordering platforms, e-commerce providers, or point-of-sale systems.

By submitting payment information, you represent that you are authorized to use the payment method provided. You agree to pay all charges, taxes, fees, delivery fees, service fees, and other amounts associated with your order or purchase.

Florida Cracker is not responsible for payment processing errors, banking issues, card issuer delays, or third-party platform problems outside of our control.

6. Refunds, Cancellations, and Order Issues

Refunds, cancellations, replacements, or credits may be handled on a case-by-case basis.

If there is an issue with your restaurant order, merchandise order, gift card purchase, catering request, or other service, please contact us as soon as possible.

For food orders, please contact the location where the order was placed. Refunds or replacements may not be available once an order has been prepared, picked up, delivered, partially consumed, or delayed due to customer error.

Third-party delivery or ordering platforms may have their own refund, cancellation, and dispute policies. If your order was placed through a third-party platform, you may need to contact that platform directly.

7. Catering and Events

Submitting a catering, private event, group dining, or event inquiry does not guarantee availability, pricing, booking, or confirmation.

Catering and event services are not confirmed until Florida Cracker provides written confirmation and any required deposit, agreement, or payment has been completed.

Catering and event pricing, minimums, menu selections, service fees, deposits, cancellation terms, staffing charges, taxes, and other requirements may vary based on location, date, party size, menu, and service type.

Any separate catering agreement, event agreement, proposal, or invoice will control if it conflicts with these general Terms.

8. Gift Cards and Gift Certificates

Florida Cracker gift cards and gift certificates are subject to applicable law and any additional terms provided at the time of purchase or issuance.

For gift cards or gift certificates purchased for monetary value in Florida, Florida Cracker will not impose expiration dates or post-sale fees except where permitted by applicable law.

Promotional certificates, loyalty rewards, donated certificates, charitable certificates, employee-incentive certificates, coupons, discounts, and limited-time offers may be subject to expiration dates, restrictions, blackout dates, or other limitations where permitted by law.

Gift cards and gift certificates are not redeemable for cash except as required by law. Florida Cracker is not responsible for lost, stolen, damaged, destroyed, or unauthorized gift cards, except where required by law.

9. Promotions, Coupons, Specials, and Offers

Promotions, coupons, discounts, specials, loyalty offers, and other offers may be subject to additional terms, restrictions, expiration dates, location limitations, menu limitations, quantity limits, or blackout dates.

Offers may not be combined unless expressly stated. Florida Cracker may modify, suspend, or cancel promotions at any time, subject to applicable law.

We reserve the right to refuse any promotion, coupon, discount, or offer that appears altered, copied, expired, fraudulent, unauthorized, or used in violation of its terms.

10. Merchandise and Online Store Purchases

If Florida Cracker offers merchandise, apparel, retail products, or other items through an online store, those purchases may be fulfilled by Florida Cracker or by third-party e-commerce, shipping, or fulfillment providers.

Product availability, descriptions, prices, shipping times, taxes, fees, and return policies may vary and may be subject to separate terms.

We reserve the right to correct errors, cancel orders, limit quantities, or refuse purchases where necessary due to inventory issues, pricing mistakes, suspected fraud, or other reasonable business reasons.

11. Alcoholic Beverages

Some Florida Cracker locations may offer alcoholic beverages.

You must be at least 21 years old to purchase, possess, or consume alcoholic beverages. Valid government-issued identification may be required.

Florida Cracker reserves the right to refuse alcohol service to any person where required or permitted by law, including individuals who appear underage, intoxicated, unable to provide valid identification, or otherwise ineligible to be served.

Alcohol availability may vary by location and may be subject to local laws, licensing requirements, hours of sale, delivery restrictions, and other limitations.

12. Food Allergens, Ingredients, and Nutrition

Florida Cracker prepares food in kitchens where common allergens may be present, including but not limited to milk, eggs, fish, shellfish, tree nuts, peanuts, wheat, soy, sesame, and other allergens.
